These terms govern access to the website pivotando.es and the general conditions for engaging the professional services provided by its owner. Please read them carefully before requesting any service.
1. Service provider
The services described on the pivotando.es website are provided by Rubén Fos Carmona (Tax ID 21700004X), a self-employed professional with registered address at Calle San Vicente de Paúl 20, 46019 Valencia, Spain (hereinafter "Pivotando").
2. Acceptance of terms
Accessing the website and requesting any service implies the full and unconditional acceptance of these terms. If you do not agree with any provision, please do not use the website or engage the services. For contracted services, a specific agreement or proposal will be signed and will prevail over these general terms in case of contradiction.
3. Services offered
Pivotando offers consulting and professional management services for Amazon accounts, including but not limited to:
- Full Amazon account management (strategy, PPC, content, catalog, operations).
- Amazon Sponsored Products / Brands / Display campaign management.
- Listing optimization and A+ Premium content modules.
- International marketplace expansion (US, ES, DE, IT, FR, NL, PL, BE, SE, IE, UK).
- FBA fee audit and reimbursement.
- Fractional strategic consulting.
The specific scope, deliverables, duration and price of each service shall be agreed in writing in a commercial proposal or signed agreement before the service starts.
No guarantee of results: Pivotando does not guarantee specific financial outcomes. The figures, metrics and case studies shown on the website reflect historical results of real clients and do not constitute a promise of future performance. Outcomes depend on multiple factors outside of Pivotando’s control (category, competition, product, investment, market conditions, decisions made by Amazon).
4. Discovery calls and bookings
Initial strategic calls (free 30-minute audit) are free and can be booked through the form on the website. Pivotando reserves the right to decline requests that do not match the client profile its services are designed for, in which case the requester will be notified with a reasoned response.
5. Pricing model and payments
The standard fee structure combines a flat monthly retainer and, after the initial pilot, a variable share of net profit lift generated (never on gross revenue or ad spend).
The initial 90-day pilot runs at a flat fee. Specific amounts, billing frequency and payment method shall be set out in each signed commercial proposal.
Payments shall be made by bank transfer or secure payment gateway. Prices shall include or itemize the applicable taxes (VAT where applicable) under the relevant regulations. Pivotando shall issue the corresponding invoice in accordance with Spanish law.
6. Duration, renewal and cancellation
The initial pilot has a duration of 90 days. After the pilot, services are rendered in renewable 30-day cycles, cancellable by either party via written notice before the next cycle begins.
No refunds shall apply to services already rendered. Cancellation shall not affect obligations accrued prior to it. Pivotando may also terminate the engagement early on the grounds of client breach or supervening impossibility to perform.
7. Intellectual property
All website content (text, images, brand, graphic design, source code) is the property of Pivotando or of third parties who have authorised its use. Its reproduction, distribution or modification requires prior written authorisation.
Deliverables generated during the engagement (audits, strategic plans, listing copy, creative assets, campaign structures) shall become property of the client upon full payment of the corresponding amounts. Pivotando retains the right to use the general learnings, methodologies and proprietary know-how developed in the project.
8. Confidentiality
Pivotando undertakes to keep confidential all client information to which it has access during the provision of the services, including financial data, commercial strategy, Seller Central and Ads Console accesses, and any other non-public information. The confidentiality obligation shall remain in force after the end of the contractual relationship.
9. Limitation of liability
Pivotando is not liable for damages arising from the use of the information published on the website for purely informative purposes. Pivotando’s liability for contracted services shall be limited in any case to the amount actually paid by the client during the period in which the service in question was rendered.
In particular, Pivotando shall not be liable for: suspensions, blocks or sanctions imposed by Amazon on the client beyond its control; changes in Amazon’s policies that affect performance; or actions of third-party providers (Amazon, logistics providers, manufacturers, etc.).
10. Personal data processing
The processing of personal data of the client and of website users is governed by the Privacy Policy, which the user declares to have read and accepted.
11. Modifications
Pivotando reserves the right to modify these terms at any time. Changes shall take effect from the moment of their publication on the website. For ongoing engagements, the terms in force at the time of signing the specific proposal or agreement shall apply, unless agreed otherwise in writing.
12. Applicable law and jurisdiction
These terms are governed by Spanish law. For the resolution of any dispute, the parties expressly submit to the Courts of Valencia, Spain, waiving any other jurisdiction that might apply, unless mandatory law imposes another forum.
